Home Office Agreement
Ordering
1. In accordance with and taking into consideration the regulation for setting up the home office, you will order office furnishings (hereinafter referred to as: “resources”) through the associated portal provided by Stater.
In doing so, you declare that you will use these resources for setting up your home office where you will work for Stater.
2. You must use the budget of € 750 including VAT to purchase all the resources (i.e. desk, desk chair and monitor) for setting up a home office that complies with ergonomic principles. Only if you already possess one or more of these resources and they fulfill the ergonomic principles can you spend the budget on only one or two of the above-mentioned resources, specifically a desk, desk chair and/or monitor.
You must spend your budget all at once so that you can set up your workspace in an ergonomic manner according to Stater’s instructions for safe and healthy working from home. If there is budget left over because you already have ergonomic furnishings prior to the budget allocation, then you can use the remaining budget (within the valid period) for replacing a defective desk, desk chair and/or monitor at a later date. Any additional costs above and beyond the remaining budget will be at your expense. The budget and any remaining budget will be available to you for the duration of five calendar years, calculated from the year in which you are allocated the budget.
3. Stater will pay for the costs of the resources that are ordered through the associated portal provided by Stater, provided that these costs are within the allocated budget. If the total purchase price of the ordered resources exceeds the allocated budget due to your selection of resources, then the supplier will bill you directly for the exceeding amount.
4. The resources will immediately become your property. In principle, the duration of use of the resources is five years. You must primarily use the resources for work activities on behalf of Stater.
5. You agree to and will follow the instructions given and to be given by Stater for working from home and comply with Stater’s regulation for setting up the home office and the conditions for participation specified therein. These regulations are an inextricable component of this agreement.
6. Stater will share your name and e-mail address with the supplier within the framework of this agreement.
Delivery and warranty
7. The resources will be delivered by the supplier. Immediately after the supplier has delivered the resources to you, you must verify that the resources do not have any defects. If the resources exhibit defects after the delivery, you are obligated to immediately notify the supplier of this.
8. When you receive the resources, you and the supplier will sign the delivery receipt. With this you will be declaring that you received the resources in good order from the supplier on that date.
9. Exceedance of a standard delivery deadline does not entitle you to compensation for damages or any other form of compensation.
10. You must read all the instructions, conditions, safety guidelines and directions for use of the resources and strictly comply with these.
11. The supplier’s warranty conditions apply to the resources. If a defect is found on (one of) the resources, please contact the supplier.
12. The resources will become your property. You will be expected to use the resources in a careful and responsible manner, since Stater has (largely) borne the costs, and to do everything possible to prevent damage, destruction and disappearance of the resources.
Being safe and healthy while working from home
13. It is important that you set up your home office in accordance with ergonomic principles so that you can work in a safe and healthy manner. Stater has established instructions for safe and healthy working from home. Information and instructions on this can be found on Staternet.
You are familiar with the instructions for safe and healthy working from home. You’ve familiarized yourself with the instructions for properly setting up an ergonomic home office.
14. You may only work from home if your home office fulfills the ergonomic principles, complies with Stater’s instructions for safe and healthy working from home and you use this correspondingly configured home office. By signing this agreement, you declare that your home office complies with Stater’s instructions for safe and healthy working from home. You are personally responsible for this, and Stater can verify it at any time.
15. You can use your own resources such as a desk chair, desk and/or monitor. However, it is important that you can set up your home office with these resources according to Stater’s guidelines for being safe and healthy when working from home. Stater can check whether your workspace complies with these guidelines at any time; see below.
16. You are aware that your home office can be checked by (or on behalf of) Stater, so that Stater can determine whether your workspace complies with the ergonomic principles. The check will entail your home office being physically viewed and inspected; the check can also take place through photos and video connection. The check will take place in consultation with you. When the supplier delivers resources, the supplier can set up these resources according to the ergonomic principles.
17. Naturally, you must also comply with Stater’s code of conduct when working from home, including but not exclusively the applicable Stater information security policy.
(Premature) termination of the agreement
8. If, for example, there is a change in your situation and/or a check of your home office shows that it does not comply (any longer) with the instructions for safe and healthy working from home, Stater may decide that you can no longer work from home. You should report it to your supervisor immediately if your home office has changed and you can no longer comply with these instructions.
19. If you leave the company’s employment on your own initiative within six months after allocation of the budget, a repayment arrangement will apply: you will pay 75% of the budget you have spent (up to a maximum amount of 75% of € 750). You will then have the option to resell the resources.
20. Stater may, in consultation with you or unilaterally, decide that you can no longer work at home if there is a valid reason for this. This includes – but is not limited to – the situation where the home workstation no longer complies with the instructions for safe and healthy working from home, but also, for example, where it would be better for the proper performance of your job or activities if you could perform your work from the office, or where Stater decides for another good reason that you may no longer work from home.
